Terms of Service

These FixUrb Global Terms of Service (the “Terms”) constitute a legally binding agreement between the User of the Platform (“you”) and FixUrb (“FixUrb”, “we”, “us” or “our”) governing your use of FixUrb’s websites, mobile applications, and related services (collectively, the “Platform”).

1. The Platform is a Venue

The FixUrb Platform is an online marketplace which enables connections between Customers and Providers. “Customer(s)” are individuals and/or businesses seeking to obtain services (“Services”), and “Provider(s)” are businesses seeking to perform Services for Customers. Customers and Providers are referred to herein together as “Users”.

Providers are independent business owners. Providers are independent contractors of Customers and not employees, partners, representatives, agents, or joint venturers of FixUrb. FixUrb does not perform Services and does not employ individuals to perform Services.

Users hereby acknowledge that FixUrb does not supervise, scope, direct, control or monitor Providers’ work and has no control over the quality, timing, legality, failure to provide, or any other aspect whatsoever of any Services.

2. Provider Relationships

Independent Contractors: You acknowledge that Providers are independent contractors and not employees, partners, or agents of FixUrb. Providers are responsible for their own equipment, insurance, and compliance with all applicable laws.

Insurance: We do not provide any form of insurance for Providers or their services. Providers are solely responsible for obtaining their own liability insurance to cover any damages or incidents that may occur while providing their services.

3. Pricing, Payments, and Refunds

Pricing: Providers set their own prices for their services. To the customer, FixUrb adds a secure booking fee of 10% to the Provider's quote at checkout. This fee covers payment processing, platform maintenance, and customer support.

Payments: All payments are processed through our third-party payment processor, Stripe. By using our service, you agree to their terms and conditions.

On-Site Price Adjustments: Quotes are provided based on the details submitted by the Customer. If a Provider arrives on-site and determines that the scope of work is substantially different than described (e.g., requiring more time, effort, or materials), the Provider has the right to re-evaluate the price. The Provider must discuss and get approval for any price change from the Customer *before* any work begins. If the Customer declines the new price, they may cancel the service. In such cases, the secure booking fee may be non-refundable to compensate the Provider for their travel and time.

Refund Policy: FixUrb is a platform that connects Customers and Providers; we are not a party to the service agreement between them and are not responsible for issuing refunds beyond the scope outlined herein.

  • All services are generally considered final sale. Refunds are evaluated on a case-by-case basis and are at the sole discretion of FixUrb.
  • A full refund will be issued to the Customer if a Provider fails to show up for a scheduled service ("no-show").
  • No refund will be provided if a service is cancelled by the Customer less than 24 hours before the scheduled service date and time.
  • All other refund requests must be resolved directly between the Customer and the Provider. We are not obligated to mediate or resolve any such disputes.

Post-Service Issues: If you have any complaints or issues regarding the quality of the service provided, you must notify FixUrb through our platform's support channel within two (2) hours of the service completion time as marked by the provider. This allows us to promptly investigate the matter with the service provider. Failure to report issues within this timeframe may limit our ability to assist in resolving the matter.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, IN NO EVENT SHALL FixUrb, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR PROVIDERS; (iii) ANY SERVICES, OR LACK THEREOF, PROVIDED BY A PROVIDER; OR (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT FixUrb ASSUMES ZERO RESPONSIBILITY OR LIABILITY FOR ANY DISPUTES, CLAIMS, LOSSES, INJURIES, OR DAMAGES OF ANY KIND THAT MIGHT ARISE OUT OF OR RELATE TO THE ACTS OR OMISSIONS OF ANY CUSTOMER OR PROVIDER, INCLUDING, BUT NOT LIMITED TO, ANY CUSTOMER'S OR PROVIDER'S FAILURE TO PROVIDE OR PAY FOR SERVICES, ANY PROPERTY DAMAGE, PERSONAL INJURY, OR THE QUALITY OF THE SERVICE PERFORMED. WE ARE NOT RESPONSIBLE IN ANY WAY FOR THE SERVICES RENDERED.

5. Indemnification

You agree to defend, indemnify, and hold harmless FixUrb and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your interaction with any Provider or customer.

6. Dispute Resolution

To expedite resolution and reduce the cost of any dispute, controversy or claim related to the Service or these Terms, you and FixUrb agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating any arbitration or court proceeding.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
