Provider Agreement & Requirements
Last Updated:
This Provider Agreement (“Agreement”) is a legally binding contract between you (“Provider,” “you,” or “your”) and FixUrb (“FixUrb,” “we,” “us,” or “our”). This Agreement governs your use of the FixUrb platform to offer and perform services for customers. By registering as a Provider on our platform, you agree to these terms.
1. Relationship of the Parties
You acknowledge and agree that you are an **independent contractor**, not an employee, partner, or agent of FixUrb. You are responsible for your own business operations, taxes, and compliance with all applicable laws. FixUrb does not direct or control your work, the manner in which you perform services, or your pricing. We provide a platform to connect you with potential customers.
2. Provider Eligibility & Requirements
To be a provider on the FixUrb platform, you must meet and maintain the following requirements at all times:
- Legal & Business Status: You must be legally eligible to work in Canada and operate as a sole proprietor or a legally registered business.
- Insurance: You must maintain, at your own expense, a comprehensive Commercial General Liability insurance policy with a minimum coverage of $2,000,000. This policy must cover property damage, bodily injury, and completed operations. You must provide proof of this insurance upon request.
- Licensing & Qualifications: You must possess all necessary licenses, permits, and certifications required by provincial and local laws for the services you offer.
- Accurate Information: All information provided in your profile, including your business name, services offered, and qualifications, must be truthful and accurate.
- Background Check: You consent to a background check, which may be conducted by a third-party service, as part of the onboarding process.
3. Provider Code of Conduct
As a representative of your own business on our platform, you agree to adhere to the following standards:
- Professionalism: Maintain a high level of professionalism, including punctuality, clear communication, and respectful interaction with all customers.
- Quality of Work: Perform all services to a high standard, consistent with industry best practices.
- Communication: Respond to customer inquiries and service requests in a timely manner. All communication regarding jobs sourced through the platform must be conducted on the platform.
- Accurate Quoting: Provide fair and accurate quotes based on the information provided by the customer. Any changes to the scope of work or price must be discussed and agreed upon with the customer through the platform *before* work begins.
- Dispute Resolution: Make a good faith effort to resolve any disputes directly with the customer. FixUrb may mediate if necessary but is not a party to the service agreement.
4. Platform Fees & Payments
FixUrb charges a service fee on each completed job, which is a percentage of your quoted amount. This fee is deducted automatically from the customer's payment before the funds are disbursed to you. The current fee structure is outlined in the Terms of Service. All payments for jobs sourced through FixUrb must be processed through our designated payment processor (Stripe). Attempting to collect payment off-platform is a violation of this agreement and will result in removal from the platform.
5. Limitation of Liability & Indemnification
FixUrb is a platform for connecting parties and is not responsible for the performance or quality of services rendered. You agree to indemnify and hold harmless FixUrb from any claims, damages, or losses arising from your actions, your failure to perform services, or any disputes with customers.
6. Termination
You may cease using the platform at any time. FixUrb reserves the right to deactivate or terminate your account at our discretion for violations of this Agreement, our Terms of Service, or for any activity that negatively impacts the integrity of the platform.
